Purpose of this privacy policy

This privacy policy aims to give you information on how BlueMatrix collects and processes your personal data, including any data you may provide through this website, purchase a product or service, use our services, or which we collect from you directly such as in person, by telephone, email, or through third parties.

This website is not intended for children and we do not knowingly collect data relating to children.

It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

This policy does not apply to the extent we process your personal data in the role of a processor or service provider on behalf of our customers.

Profile and Contact Information

We receive the personal information you provide, such as your name, phone number, email address and company name and other contact information when you contact us regarding, and enter such information (the "User-Uploaded Information") to obtain, any services, data, products, white-papers and/or information provided by BlueMatrix (the "Products"), and/or when you add such information to register for, or respond to an invitation to, a BlueMatrix sponsored or related event (an "Event"). We use this information to contact you and provide the Product information you requested and possibly in connection with the provision of Products, and/or where applicable, in connection with the Event. We may also use this information to contact you regarding our other Products and, in connection with certain Products, we may send you Product-related news and other news and information that we believe may be of interest to you. If you wish to unsubscribe from these communications, please follow the instructions in the communication or contact an Account Manager. Also, please note that we will separately obtain express consent from you before contacting you whenever we are required to do so by law (such as the Canadian "anti-spam" law).

Notice to End Users

BlueMatrix products are intended for use by organizations and are made available to you by your organization. Your use of BlueMatrix products may be subject to your organization’s policies, if any. If your organization is administering your use of BlueMatrix products and services, please direct your privacy inquiries to your organization’s administrator. BlueMatrix is not responsible for the privacy or security practices of our clients, which may differ from those set forth in this privacy statement.

If you use an email address provided by an organization you are affiliated with, such as your employer, to access BlueMatrix online services, the owner of the domain associated with your email address may control and administer your BlueMatrix online services account and access and process your data, including the contents of your communications and files.

Controller

This privacy policy is issued on behalf of the BlueMatrix Group so when we mention "BlueMatrix", "we", "us" or "our" in this privacy policy, we are referring to the relevant company in the BlueMatrix Group responsible for processing your data. We will let you know which entity will be the controller for your data when you purchase a product or service with us. BlueMatrix I, LLC is the controller and responsible for this website.

We have appointed a data protection officer who is responsible for overseeing questions in relation to this privacy policy. 2. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

Identity data includes title, first name, last name, username or similar identifier
Contact data includes billing address, delivery address, email address and telephone numbers, postal address
Technical data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, device identifiers and other technology on the devices you use to access this website
Profile data includes your username and password, purchases or orders made by you, preferences, feedback and survey responses, questions and information you send to us
Usage data includes information about how you use our websites, products and services

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

3. How is your personal data collected?

We use different methods to collect data from and about you including through:

Direct interactions. You may give us your Identity, Contact and Financial data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you apply for our products or services; create an account on our website; subscribe to our service or publications; request marketing to be sent to you; enter a survey; or give us feedback or contact us.

Interactions with your employer. Your employer, as a customer or partner of BlueMatrix, may provide your contact information as required to provide BlueMatrix products or services. We also collect personal information where you or your employer is a customer of a business we may acquire. We may also collect information about you on CCTV when you visit our premises or on other security cameras as part of our security and crime prevention measures. Our website(s) may also collect information about your visits to the website(s) through cookie technology without you actively submitting such information.

Automated technologies or interactions. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. For more information about our use of cookies, please see section 4 below.

Third parties or publicly available sources. We will receive personal data about you from various third parties including Technical Data from analytics providers such as Google based in the US; advertising networks such as Google, LinkedIn, Facebook based in the US and Europe; and search information providers based in the US and Europe. We will also receive Identity and Contact Data from data brokers or aggregators such as Linkedin, ZoomInfo based in the US, as well as publicly available sources, to the extent local law allows.

4. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data where we need to perform the contract we are about to enter into or have entered into with you, or where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests, or where we need to comply with a legal obligation.

The types of lawful basis that we will rely on to process your personal data are explained below:

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We may share your personal data with other companies in BlueMatrix so that they can contact you with promotions and offerings, or if they provide hosting, infrastructure, data center and IT services for the operation of our website. We will get your express opt-in consent before we share your personal data with any company outside the BlueMatrix group of companies for marketing purposes. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving that marketing.

Third-party marketing

We will get your express opt-in consent before we share your personal data with any third party outside BlueMatrix for marketing purposes.

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by logging into the website and checking or unchecking relevant boxes to adjust your marketing preferences or by following the opt-out links on any marketing message sent to you.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

Cookies

If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. 5. Disclosures of your personal data

We may share personal data with our affiliates, service providers (including website, software, infrastructure and application providers), cloud hosting providers, database providers, backup and disaster recovery specialists, analytics and email providers, payment gateways, credit reference agencies, debt management agencies, professional advisors, marketing agencies, third-party networks and websites, and agents working on our behalf.

We may be required to share personal data with a third party or body where such disclosure is required to satisfy applicable law or other legal or regulatory requirement, or to protect our rights or property. This may include in response to lawful requests from a competent authority or body and to meet national security or law enforcement requirements.

If all or any part of our business is re-organized or sold to or there is a joint venture with another organization, we may need to provide your personal data to that organization. We may also be the recipient of personal data when we acquire another organization or a part of their business or enter into a joint venture with another organization.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

6. International transfers

Personal data may be processed outside the country of your residence by our affiliates, partners or service providers and agents working on our behalf. The transfer to other countries by BlueMatrix will be in accordance with applicable data protection legislation, which may include an adequacy decision or appropriate safeguards. Appropriate safeguards may include: BlueMatrix and third parties entering into the EU Standard Contractual Clauses approved by the European Commission or the International Data Transfer Agreement and UK Addendum to the EU Standard Contractual Clauses.

7. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data retention

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

We have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for seven years after they cease being customers for tax purposes.

In some circumstances we will anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

9. Choice

If personal data covered by this Privacy Policy is to be used for a new purpose that is materially different from that for which the personal data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party in a manner not specified in this Policy, BlueMatrix will provide you with an opportunity to choose whether to have your personal data so used or disclosed. Requests to opt out of such uses or disclosures of Personal Data should be sent to us as specified in the “Contact Details” section above

10. Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. Your rights may differ depending on your place of residence.

GDPR, the UK’s Data Protection Act and Switzerland’s Federal Act on Data Protection provide the following rights to citizens of the EEA, the UK and Switzerland respectively:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

GDPR and the UK’s Data Protection Act provide additional rights for EEA and UK citizens to:

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data if you want us to establish the data's accuracy, or where our use of the data is unlawful but you do not want us to erase it, or where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims, or you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

You may also have the right to complain to the competent data protection supervisory authority. Data Privacy Framework

International Data Transfers

This Data Privacy Framework Policy (the “Policy”) applies to transfers of personal data from the European Economic Area (EEA), the United Kingdom (UK) and Gibraltar, and Switzerland to the United States.

BlueMatrix complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. BlueMatrix has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. BlueMatrix, Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Personal data may be processed on servers located outside of the country where you reside. Our Privacy Policy describes the way we protect your personal data. In addition to those protections, we provide the following protections in respect of data transfers from the EEA, UK (and Gibraltar) and Switzerland.

Adequacy Decisions

Where the European Commission has made an “adequacy decision” in respect of a country outside the European Economic Area (EEA) (i.e. determined that the country provides adequate data protection), personal data can be transferred from the EEA to that country without further safeguards being necessary. The UK and Switzerland have adopted similar adequacy mechanisms to allow personal data to be sent to countries that they consider provide adequate data protection. BlueMatrix, Inc. relies on the European Commission’s adequacy decisions, as well as the UK adequacy regulations and Swiss adequacy decisions.

Standard Contractual Clauses

Where there is no adequacy mechanism in place, we rely on Standard Contractual Clauses (SCCs) for data transfers from the EEA, the UK and Switzerland to third countries as these provide appropriate data protection safeguards. SCCs have been approved by the European Commission and must be used in their original form without modification.

BlueMatrix will cooperate with the applicable data protection authority in the investigation and resolution of complaints brought under the DPF. BlueMatrix will comply with any advice given by the EU DPAs, the FDPIC, or the ICO with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF. The alternative dispute resolution services of the data protection authorities are provided at no cost to you.

If a dispute or complaint cannot be resolved by BlueMatrix or by the EU DPAs, the Swiss FDPIC, or the UK ICO, you have the right to require that BlueMatrix enter into binding arbitration pursuant to the DPF’s Recourse, Enforcement and Liability Principle and Annex I of the DPF.

BlueMatrix is subject to the investigatory and enforcement powers of the US Federal Trade Commission.

We remain liable for any of your personal information that is shared by us with third parties for external processing on our behalf.

U.S. STATE-SPECIFIC NOTICE

If you are a consumer resident in certain U.S. states, including California or Virginia, you have the following rights such as those provided under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act or “CPRA” (collectively, the “CCPA”) and the Virginia Consumer Data Protection Act (“VCDPA”):

To Know the categories of personal information collected, specific pieces of personal information collected, the categories of sources from which the business collected personal information, the purposes for which the business uses the personal information, the categories of third parties with whom the business shares the personal information, and the categories of information that the business sells or discloses to third parties. For the purposes of this right, the categories of personal information are provided in the above privacy notice.

Request access to the personal information we maintain about you. This enables you to receive a copy of the specific pieces of personal information we hold about you. BlueMatrix reserves the right to verify your identity prior to providing any such information.

Request correction of inaccurate personal information we maintain about you.

Request deletion of the personal information we have collected from you, and maintain about you. However, please note that there are some exceptions that allow businesses to keep your personal information in accordance with legal requirements.

Opt out of the “sale” of your personal information. BlueMatrix does not ‘sell’ your personal information for monetary or other benefit, as that term is commonly understood. However, some uses of cookies and tracking technologies placed on our website may be considered a ‘sale’ under certain U.S. state laws.

Opt out of the “sharing” of your personal information for cross-contextual behavioral advertising, or opt out of ‘targeted advertising’. As noted, BlueMatrix uses certain third party tracking technologies placed on our website in order to advertise to you on other websites. These third parties may constitute a ‘share’ under California law and ‘targeted advertising’ under Virginia and other state laws. You may opt out of such cookies as detailed in our cookie policy.

‘Do Not Track’: BlueMatrix currently does not recognize ‘Do Not Track’ signals, or ‘Opt-Out Preference Signals’ that are automatically sent by certain web browsers.
